A Midlothian man who refused medical treatment after recovering from a coughing attack claims police handcuffed, Tasered and forced him into an ambulance.

Stephen Kolasa's lawsuit against two doctors and South Suburban Hospital claims he suffered medical battery and intentional inflictions of emotional distress. The case was filed Wednesday in Cook County Circuit Court.

Kolasa says he was at his home at 11430 S. Homan Ave. on Dec. 12, 2008, when he had a coughing fit and momentarily lost consciousness.

Kolasa's wife called 911 and shortly after, Kolasa regained consciousness and stated he felt fine and did not want medical attention, the lawsuit said.

Kolasa refused treatment when an ambulance arrived with paramedics and one police officer, explaining that he felt fine. Paramedics and the officer allegedly refused to leave, a second officer was called and Kolasa allegedly ended up Tasered multiple times in the shoulder, seized, handcuffed and forcefully taken to South Suburban Hospital in Hazel Crest, the lawsuit said.

Once at South Suburban, Kolasa was forced to disrobe and have his blood drawn despite his refusal.

Most States have this kind of right over the citizens, enforced through manus militari if necessary.

Of course, it only goes one way: they can force you, if you are a Jehova's witness for instance, to receive a blood transfusion, but they cannot force you, again if you are a Jehova's witness, to give blood. Some will support their pro abortion stance on this same premise: the State cannot force you to lend your body so another entity can live off of it.

I have not heard of such a thing. I tried a google and it brought up nothing.

I have never heard of a law in America that says police can drag you out kicking and screaming, unless they have probable cause to believe you are a danger to yourself or others which almost exclusively applies to cases of suicidal people.

This man had a severe cough, far from suicidal if you ask me.

I assumed it existed in the States because otherwise I don't think they would have risked a lawsuit, even if forcing someone on an abulance seems extreme.

We had a case here, a couple of years back, when a couple, out of religious beliefs, did not want to treat their son in a hospital. The State won and they were forced to "surrender" the child to "Western medicine".
